Terms of service
Published Smartrobe policy · Last updated October 4, 2026.
These Terms of Service ("Terms") are an agreement between you and Smartrobe Holdings LLC, a Florida company ("Smartrobe", "we", "us"), and govern your use of the Smartrobe app, its widgets and Siri shortcuts, and related web pages such as poll pages at p.smartrobe.com (together, the "Service").
Please read section 15 (Arbitration and class-action waiver) carefully. It requires most disputes to be resolved by individual arbitration rather than in court or as a class action, unless you opt out within 30 days.
1. Accepting these Terms
By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service. If you use the Service for an organization, you confirm you're authorized to accept these Terms for it.
2. Who can use Smartrobe
You must be at least 13 years old (or the minimum age in your country). If you're under 18, you confirm a parent or guardian has agreed to these Terms. You may not use the Service if you're barred from doing so by law.
3. Your account
You're responsible for your account, keeping your password secure, the accuracy of the information you give us, and everything that happens under your account. Tell us promptly at support@smartrobe.com if you suspect unauthorized use. One person per account; don't sell, transfer or share it.
4. The Service
Smartrobe helps you organize your wardrobe and offers outfit ideas, weather-based suggestions, trip planning, a styling assistant ("Aura"), Look Check, avatars and virtual try-ons, shopping suggestions, a wishlist, polls, sharing tools and related features. We may add, change, limit or remove features at any time. We don't guarantee the Service will always be available, uninterrupted or error-free.
5. Subscriptions, free trials and payments
- Plans. Some features require a paid subscription ("Plus" or "Pro"). Plans, prices and usage limits are shown in the app before you buy and may differ by country.
- Billing. Subscriptions are purchased through Apple's App Store or Google Play and billed by them to your store account. Subscriptions renew automatically at the end of each period at the then-current price unless you cancel at least 24 hours before the period ends.
- Cancelling. Manage or cancel in your App Store or Google Play account settings. Deleting the app or your Smartrobe account does not cancel a subscription.
- Free trials. If a plan includes a free trial, you'll be charged when the trial ends unless you cancel at least 24 hours before. Unused trial time is forfeited when you buy a subscription, where the store allows.
- Refunds. Refunds are handled by Apple or Google under their policies; we can't issue refunds for store purchases.
- Changes. We may change prices or plan contents; changes apply from your next renewal, and the store will notify you where required.
- Referral and promotional access. Free access from referrals or promotions has no cash value, may be limited, and may be withdrawn if obtained by abuse (for example, fake or duplicate accounts).
- Fair use. Plans include usage limits (for example, daily outfit suggestions or monthly image generations) to keep the Service sustainable. We may enforce reasonable limits to prevent abuse.
6. AI features: important limits
The Service uses artificial intelligence. AI output (outfit ideas, styling advice, recognized colors and categories, generated avatars and try-on images, product suggestions, packing lists and similar) is generated automatically, may be inaccurate, incomplete or unsuitable, and is provided for general inspiration only. Generated images are approximations and may not reflect how clothes actually look or fit.
AI output is not professional advice of any kind (including medical, health, safety, financial or legal advice). Weather information comes from third parties and may be wrong. Use your own judgment, for example about what's appropriate for the weather, an event or a dress code. You are responsible for decisions you make based on the Service.
7. Your content
- You own your content. Photos, wardrobe details, notes, messages, polls and other material you add ("Your Content") remain yours.
- License to us. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, adapt (for example, cleaning up a product photo or creating an avatar) and display Your Content only to operate, provide and improve the Service for you, including sending it to our service providers as described in the Privacy Policy. This license ends when you delete the content or your account, except for copies in backups kept for a limited period or content you shared publicly (such as an open poll link) until it is removed.
- Your responsibility. You confirm you have the rights to Your Content, including permission from anyone who appears in photos you upload, and that it doesn't violate these Terms or the law.
- Feedback. If you send us ideas or feedback, we may use them without obligation to you.
8. Sharing and polls
When you share a look, create a "Which one?" poll or otherwise make content available to others, you choose who sees it. Anyone with a poll link can view it. You're responsible for what you share and with whom. Content you share to other apps (Instagram, TikTok, Snapchat, Facebook and others) is subject to their terms.
9. Acceptable use
You agree not to:
- break the law, infringe anyone's rights, or upload content you don't have the right to use;
- upload content that is sexual, hateful, harassing, violent, deceptive or that exploits minors;
- upload photos of other people without their permission;
- use the Service to harass, impersonate or mislead anyone, including through polls or shared content;
- manipulate polls, referrals or promotions (for example with fake accounts or automated votes);
- copy, scrape, reverse-engineer, resell or build a competing product from the Service, except as the law allows;
- interfere with or overload the Service, bypass usage limits or security, or access other users' data;
- use the Service or its output to train AI models without our written permission.
We may remove content or restrict accounts that we reasonably believe break these rules.
10. Third-party products, links and services
Shopping suggestions, product links, prices, availability, brand names and destination photos come from third parties. We don't sell, endorse or guarantee any third-party product, store or content, and we're not responsible for purchases you make from them. Prices and stock may change. Third-party services (such as Apple, Google, Meta, and websites you visit) have their own terms.
11. Our intellectual property
The Service, including the Smartrobe name, logo, design, software, templates and the content we create, belongs to us or our licensors and is protected by law. We give you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial use under these Terms. Nothing else is licensed to you.
12. Termination
You can stop using the Service and delete your account at any time in Settings > Privacy > Delete Account. We may suspend or end your access, with or without notice, if you break these Terms, create risk or legal exposure for us, or if we stop offering the Service. Sections that by their nature should survive (including 6, 7 (Feedback), 11, 13, 14, 15 and 16) survive termination.
13. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT AND AI OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE OR THAT DATA WILL NOT BE LOST. Some jurisdictions don't allow certain disclaimers, so some of these may not apply to you.
14. Limitation of liability; indemnity
TO THE FULLEST EXTENT PERMITTED BY LAW: (a) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL OR CONTENT, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THEIR POSSIBILITY; AND (b) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR US $50. These limits apply to all legal theories and even if a remedy fails of its essential purpose, but not where the law doesn't allow them.
You agree to defend, indemnify and hold harmless Smartrobe and its owners, employees and contractors from claims, losses and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your breach of these Terms or of anyone's rights.
15. Arbitration and class-action waiver
- Informal resolution first. Before filing a claim, contact us at support@smartrobe.com with a description of the dispute; we'll try to resolve it within 60 days.
- Binding individual arbitration. Except as stated below, any dispute arising from or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. The arbitration may be held by video or phone, or in person in Miami-Dade County, Florida, or the county where you live. The arbitrator may award the same individual relief a court could.
- Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court for misuse of intellectual property.
- Class-action waiver. You and we each waive the right to a jury trial and to participate in a class, collective or representative action. Claims may only be brought individually.
- Opt-out. You may opt out of this arbitration agreement by emailing support@smartrobe.com with your name, account email and a clear statement that you opt out, within 30 days of first accepting these Terms.
- If the class-action waiver is found unenforceable for a claim, that claim will be decided in court as set out in section 16, not in arbitration.
16. Governing law and venue
These Terms and any dispute relating to them or the Service are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules, and by applicable US federal law. Subject to section 15, the state and federal courts located in Miami-Dade County, Florida have exclusive jurisdiction, and you and we consent to their personal jurisdiction. If you live in a country whose consumer laws give you rights that can't be waived by contract (for example in the EU, UK or Brazil), these Terms don't take those rights away.
17. Apple App Store terms
If you downloaded the app from Apple's App Store: these Terms are between you and us, not Apple, and we (not Apple) are responsible for the app and its content. Apple has no obligation to provide maintenance or support. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app (including product liability, legal or regulatory compliance, or consumer protection claims), or for investigating, defending or settling any third-party claim that the app infringes intellectual property. You confirm you're not in a country subject to a US Government embargo or on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. General
- Changes. We may update these Terms. We'll change the date above and, for material changes, notify you in the app or by email. Continuing to use the Service after changes take effect means you accept them.
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
- Severability. If any part is unenforceable, the rest remains in effect.
- No waiver. Not enforcing a right isn't a waiver of it.
- Assignment. You may not transfer these Terms; we may transfer them in connection with a merger, acquisition or sale of assets.
- Force majeure. We aren't liable for delays or failures caused by events beyond our reasonable control.
